By using plantsforhope.org, you agree to these Terms. If you do not agree, please do not use the site. There may be times we do not exercise a right under these Terms; that does not mean we waive that right. These Terms include a limitation of our liability.
Who we are & purpose
When we say “Plants for Hope,” “we,” “our,” or “us,” we mean the Plants for Hope plant-sale effort operated in Southeastern Wisconsin by James Houchin.
The website shares information about plant sales, care guidance, and the seasonal raise for a featured local nonprofit (this season: TAC Wisconsin / Moss Universal Park). It is not an online storefront with accounts or checkout.
No accounts; site as is
There are no user accounts on this website. The site is provided on an “as is” and “as available” basis. We care about keeping pages accurate and available, but we do not promise uninterrupted access, error-free content, or that the site will meet every visitor’s needs.
The notify form on the homepage is currently a mockup and does not create a binding signup until a live email backend is connected and we say so.
Plant purchases
- Plants are sold in person at markets, tables, and pop-ups—not through website checkout.
- Prices are as posted at the table or as we tell you in person.
- Payment at the table is by card via Square only.
- Living plants are sold as-is. Plants are living things; survival depends on light, water, temperature, handling, and care after you take them home.
- Care guidance on /care/ is informational. It is not a warranty that any plant will survive or thrive in your home.
Charitable proceeds
We send plant-sale proceeds to the featured nonprofit each season (currently TAC Wisconsin / Moss Universal Park). Buying a plant from us supports that raise through our proceeds practice; it is not the same as donating directly to TAC.
If you donate on TAC’s own site (for example via a link to universalpark.org), that gift is between you and TAC under their terms and policies. Plants for Hope does not process those donations.
Intellectual property
Site content—copy, layout, photos, and brand presentation belonging to Plants for Hope—is ours (or used with permission). You may share links to the site and quote short passages with attribution for ordinary personal or journalistic use. Do not scrape the site in a way that harms availability, copy the design wholesale, or misrepresent yourself as Plants for Hope.
Acceptable use
You agree not to:
- Use the site for illegal activity
- Attempt to disrupt, overload, or harm the site or its hosting
- Scrape or automate access in a way that degrades service for others
- Misrepresent affiliation with Plants for Hope or the featured nonprofit
Third-party links
The site may link to third parties (including TAC / Moss Universal Park, Square’s materials, or extension resources). We are not responsible for their content, availability, or policies. Following a link is at your own risk.
Limitation of liability
To the fullest extent allowed by applicable law, Plants for Hope and James Houchin are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the website, reliance on care guidance, plant purchases, or inability to use the site—whether based on contract, tort (including negligence), or any other theory—even if we have been advised that such damages are possible.
In plain language: this is a small informational site and an in-person plant table. Living plants and outdoor markets involve ordinary risks. If something does not work out as you hoped, that risk is yours within the limits the law allows us to set. Nothing here limits liability that Wisconsin or U.S. law does not allow us to limit (for example, certain personal-injury claims where a waiver would be unenforceable).
Governing law
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law rules that would push the dispute elsewhere. Courts in Wisconsin are the intended venue for disputes arising from these Terms or the website, to the extent the law allows.
Changes & contact
We may update these Terms as the site or our practices change. When we make a significant change, we will refresh the effective date at the top of this page.
